  • Estate Planning

The Nesbitt Law Firm drafts simple wills for clients for whom tax planning is not necessary.  We prepare complex wills when tax planning is required.  We also handle preparation of pour-over wills and creation of various types of trusts, such as revocable living trusts, irrevocable life insurance trusts, family foundation trusts, and private annuity trusts.  Where appropriate, we organize the creation of family limited partnerships and family limited liability companies.  In order to help our clients plan for the possibility of disability in the future, we offer durable powers of attorney and advance medical directives.  In the case of disabled beneficiaries, we offer the creation of special needs trusts.  For clients who have maintained retirement investment accounts, we handle account beneficiary designations and planning for rollovers and withdrawals.

  • Estate Administration

After the death of a loved one, we provide fiduciary services for the estate.   These services include serving as executors and administrators of the estate and advising other individuals in those roles.  We also prepare accountings for commissioners of accounts and inventories of the assets and liabilities of estates.  Our firm will prepare and file final income tax returns for the deceased, fiduciary income tax returns, and estate and gift tax returns.  In the event that there is disagreement over the existence or terms of a will, we represent beneficiaries in negotiations and in court.  We also represent clients in proceedings for substitution or removal of executors or trustees and in proceedings for modification or termination of trusts.
